Terms and Conditions of Use Coljam Consultants Limited ("we", "us") owns and operates the StocksMonthly.com web site ("our Site", "this Site", "the Site"). The site provides the results of our research on stock price changes over any given month of the year. The research shows that some stocks in particular appear to perform well (or badly) during a particular month of the year. The information is presented on an 'as is' basis and no warranty is intended or implied and is subject to our disclaimer. ("Our Services") Our Services are subject to the following terms and conditions. 1. USE OF OUR SERVICES The user of our services ("you", "the user") agrees to obey all British, American State, US Federal, EU and international laws and regulations. The user agrees not to infringe on any intellectual property rights, including, but not limited to, copyright, trademark, patent or other proprietary rights. The user agrees not to cause damage to, or attempt to cause damage to, any computer system used by us or our users. The user agrees not to obtain, or attempt to obtain confidential information from this site or about users. The user agrees not to harass other users. The user agrees not to transmit in any manner remarks which are defamatory, slanderous, libellous, threatening, harassing, or discriminatory based on gender, race, age, or promotes hate. The user agrees not to contact other users for commercial purposes. The user agrees not to help third parties in any of the foregoing. 2.1. YOUR RESPONSIBILITIES The user of our services ("you", "the user") is solely responsible for all communications and interactions with other users. We reserve the right to monitor use of the site and restrict or deny access to any user who, in our judgement, is abusing our services, or for any other reason we deem fit. You agree to accept full responsibility and all consequences resulting from, or arising out of, your use of this site. 2.2. PRIVACY A. The information which you provide to us during the registration process, specifically your email address; username; and password will only be used by us, and will not intentionally be passed on without your express permission. B. All articles or forum communication which you subsequently submit will be deemed �Free to publish� or �Public Domain�. See also section 4 User Content. C. We may cooperate fully with any law enforcement agencies requiring access to any and all information which you provide. 3. Persons under 18. This site is not intended for use of persons under 18. 4. USER CONTENT A. By submitting any content (Including text, pictures, trade marks etc) to our site you warrant and represent that (a) you are the copyright owner of such content or that the copyright owner of such content has granted you permission to use such content with the manner and purpose of your use and as otherwise permitted by these Terms and conditions, (b) you have the rights necessary to grant the licenses and sublicenses described in these Terms and conditions, and (c) that each person depicted in any and all Pictures submitted, if any, has provided consent to the use of the Picture as set forth in these Terms and conditions, including, by way of example, and not as a limitation, the distribution, public display and reproduction of such Picture. By Posting a Picture, you are granting (a) to all users of this site (b) to the general public and/or (c) to any person with whom the pictures are shared, permission to use your Picture in connection with the use, as permitted by these Terms and conditions of this site, (including, by way of example, and not as a limitation, downloading, printing and making prints and gift items which include such Picture), and including, without limitation, a non-exclusive, world-wide, royalty-free license to: copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate and reformat your Picture without having your name attached to such Picture, and the right to sublicense such rights to any supplier of this site. No compensation will be paid with respect to the use of your Picture or any other content submitted. We have no obligation to post any content that you or anyone else submits. In addition, we may, in our sole and unfettered discretion, edit, remove or delete any content that you post or submit. B. You are solely responsible for any content that you submit post or transmit via our Site. You agree not to post or submit any content that: (a) is libellous, defamatory or slanderous, (b) contains sexually explicit content (including nudity), (c) may denigrate any ethnic, racial, sexual or religious group by stereotypical depiction or otherwise, (d) exploits images or the likeness of individuals under 18 years of age, (e) makes use of offensive language or images. C. By submitting any content (including without limitation, your photograph) to our Site, you hereby grant us a perpetual, worldwide, non-exclusive, royalty-free right and license to use, reproduce, display, perform, adapt, modify, distribute, have distributed and promote such content in any form, in all media now known or hereinafter created, anywhere in the world, and for any purpose. 5. THIRD PARTY CONTENT In your use of our site, you may access content from third parties including other users ("Third Party Content"), either via our site or through links to third party sites. We make no representations or warranties about Third Party Content. You agree that under no circumstances will we be held liable in any way for any Third Party Content, including without limitation, any errors or omissions in any Third party Content or any loss or damage of any kind incurred as a result of the use of any Third Party Content. You agree to accept sole responsibility, and bear all risks associated with your use of any and all Third Party Content. 6. PROPRIETARY RIGHTS You acknowledge and agree that the site contains proprietary and confidential information that is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by us, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the content of this site, in whole or in part. 7. MEMBER REGISTRATION AND SECURITY Upon completing the site registration process you will have given yourself a unique username and password. You are solely and fully responsible for maintaining the confidentiality of your username and password, and are fully responsible for all activities that occur under your username. You agree to (a) immediately notify us of any unauthorized use of your username/password or any other breach of security, and (b) ensure that you �Sign Off� at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to comply with this Section, and (c) not permit anyone other than yourself to access the site using your username or password, if you are in breach of this condition then your subscription(s) may be immediately terminated and you may be required to pay compensation to the web site owners, and (d) no refunds of any subscriptions. 8. TERMINATION You agree that we may, with or without prior notice, immediately terminate your membership of this site. Such termination may be made entirely at our discretion. You agree that such termination may also include the deletion of all content created by you on this site. You agree that all access to information or content created by you on this site may be denied. You agree that we will not be liable to you or any third party for any termination of your access to our site. 9. MODIFICATIONS TO SERVICE We reserve the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that we shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service. 10. REPRESENTATIONS AND WARRANTIES You warrant and represent to us that (a) you are 18 years of age or older, (b) the information you have provided to us in the registration process is accurate (c) you are fully authorised and have the full power to enter into and perform under these terms and conditions (d) your use of this site will not infringe the copyright, trademark, right of publicity, or any other legal right of any third party (e) you own or have all the necessary rights and permissions of any and all content which you submit to this site. 11. DISCLAIMER OF WARRANTIES The services, this site, including without limitation, all content, products and services displayed or offered on this site, and all text, graphics, links and applications are provided to the user on an �as is� basis and without warranty of any kind. Coljam Consultants Ltd disclaims all warranties, express or implied, with respect to each of the foregoing, without limitation, any warranty of merchantability, fitness for a particular purpose, non-infringement or arising from a course of dealing. Without limiting the generality of the foregoing, Coljam Consultants Ltd specifically disclaims any warranty that (1) The services will be interrupted or error free; (2) Defects will be corrected; (3) There are no viruses or other harmful components; and (4) The security methods employed will be sufficient. 12. LIMITATION OF LIABILITY In no event shall We be liable for any damages resulting from loss of data, profits, use of this site or any of our products or services, or for any incidental, indirect, punitive, or consequential damages in connection with this agreement or in connection with any products or services provided hereunder. In no event shall our cumulative liability exceed an amount greater than fifty pounds sterling (�50 GBP) 13. INDEMNITY You agree that in no event shall we be liable to any third party for your breach or alleged breach of any of the terms and conditions set forth in this Agreement. You agree to defend, indemnify and hold harmless Coljam Consultants Ltd from any and all expenses, losses, liabilities, damages or third party claims resulting from your breach or alleged breach of any user obligations set forth hereunder. 14. JURISDICTION This Agreement is made under and shall be governed by and construed in accordance with the laws of Scotland, the United Kingdom, regardless of its choice of law provisions. The courts located in the county of Perthshire, Scotland, will have exclusive jurisdiction. This Agreement and our policies are subject to change by us without notice. Continued usage of the Services after a change to this Agreement by us or after a new policy is implemented and posted on the Site constitutes your acceptance of such change or policy. We encourage you to check our terms and conditions regularly for any changes or additions.
